Hereinafter referred to as “the user”.

The present conditions govern the sale of any product or service presented on the Coeur Cristal website by

SASU COEUR CRISTAL

The parties agree that their relationship shall be governed exclusively by this contract, to the exclusion of all other conditions.

Any order duly validated on the Coeur Cristal website implies total and unreserved acceptance of the present general conditions of sale and, where applicable, of any special conditions specific to one or more products, services or orders.

 If a condition is lacking, it will be considered to be governed by the practices in force in the distance selling sector whose companies are based in France. SAS COEUR CRISTAL undertakes to comply with all the provisions of the French Consumer Code relating to distance selling.

SUBJECT

The purpose of these conditions is to define the terms and conditions of sale between the seller and the user, from the order to the services, including payment and delivery.

They regulate all the steps involved in placing an order and ensure the follow-up of the order between the contracting parties.

ORDERING AND AVAILABILITY

The user declares  to be at least 18 years of age and to have the legal capacity or to hold parental authorisation to place an order on the Site.

Any order implies acceptance of the prices and description of the products available for sale.

The user declares that he/she has read and accepted these General Terms and Conditions of Sale before placing an order. Validation of your order therefore implies acceptance of these General Terms and Conditions of Sale.

DELIVERY

 The delivery deadline corresponds to the shipping time indicated on the item sheet, plus the delivery time.

Our delivery times from the time of order are 8 days maximum.

Our delivery rates are indicated in the shopping basket, depending on the delivery address.

If the seller becomes aware of a total delivery time in excess of , it will, as soon as it becomes aware of it, indicate to the user a new reasonable delivery time in relation to the one initially foreseen.

In any event, no delivery period may exceed 30 days.

In the event of a further delay, the user will be offered the option of cancelling the initial order until the product is restocked.

Any order placed on the site and delivered outside France and, in general, outside the European Union may be subject to possible taxes and customs duties which are imposed when the parcel reaches its destination. These customs duties and taxes are the responsibility of the user. The seller is not obliged to check and inform about applicable customs duties and taxes. To find out about them, we  advise the user to check with the relevant authorities in his or her country.

 PRICE

 The prices of our products are indicated in euros, all taxes included, excluding shipping costs, which will be indicated on the summary page prior to payment.

The seller reserves the right to modify its prices at any time but the products will be

invoiced on the basis of the rates in force at the time orders are registered.

The prices indicated on the site are guaranteed for the duration of the publication.

 

RIGHT OF WITHDRAWAL / RETURN / EXCHANGE

In accordance with the Hamon law of March 18, 2014, the user has a period of fourteen (14) days to exercise his right of withdrawal by returning the item(s) ordered to the seller without having to justify his reasons or pay any penalties with the exception of the advance payment of return costs based on the lowest shipping rate indicated in our price list and included in the refund. The period of fourteen days runs from the date of receipt of the items.

The user has fourteen days from notification of withdrawal (by e-mail or post, indicating the references of the order) to return the package to the seller.

The returned product must be complete, in packaging that allows it to be transported without risk and in the same condition as when it was received.

The refund, including shipping and return costs based on the most advantageous rate offered by this site,  will be made within a maximum of 14 days  or, in the case of an exchange, will be effective after receipt and inspection of the product by the seller. Returns “carriage paid by recipient” or cash on delivery will be refused.

Products damaged or soiled by the customer will never be refunded or exchanged.
In the event of improper returns, the seller reserves the right to refuse any further orders.

The full refund of the order will then be made within a reasonable time and at the latest within 30 days following the date of receipt of the parcel.

RESPONSIBILITY

SAS COEUR CRISTAL has an obligation of result at all stages of the order process and after the conclusion of the contract.

Thus the seller undertakes to describe the products sold on the Coeur Cristal website as accurately as possible. However, the seller may not be held liable in the event of non-performance of its obligations being attributable either to the unforeseeable and insurmountable act of a third party to the contract, or to a case of force majeure as defined by French case law. Likewise, the seller may not be held liable for any inconvenience or damage inherent in the use of the Internet, in particular a break in service, external intrusion or the presence of computer viruses.

PERSONAL DATA

The seller reserves the right to collect such data.
Nominative data communicated by the user or collected via the operation of the site (by means of cookies or active x) are intended to ensure the proper completion of deliveries, to improve the quality of service and to better meet customer expectations. The user consents to the use of this data by the seller, in particular to communicate information relating to services and promotional offers that may be of interest to the user.

All elements of the Coeur Cristal site, whether visual or audio, including the underlying technology, are protected by copyright, trademarks or patents.

INTEGRALITY
Should any clause of the present contract become null and void as a result of a change in legislation, regulations or a court ruling, this shall in no way affect the validity of and compliance with the present general terms and conditions of sale.

DURATION
The present conditions apply for the duration of the online services offered by SAS COEUR CRISTAL,

PROOF
The computerized registers, kept in the computer systems of Sas Coeur Cristal and its partners under reasonable conditions of security, will be considered as proof of communications, orders and payments between the parties.

PRESERVATION AND ARCHIVING OF TRANSACTIONS
Purchase orders and invoices are archived on a reliable and durable medium in such a way as to correspond to a faithful and durable copy in accordance with article 1348 of the French Civil Code.

APPLICABLE LAW AND JURISDICTION
These conditions are governed by French law. In the event of a dispute, the competent court will be that of the defendant’s place of residence.
